Notice of Filming and Photography and Release

When you enter a Kantorei event or program, you enter an area where photography, filming, and/or recording may occur. By entering the event premises, you consent to such photography, filming, audio and video recording and to the use of your appearance, photograph, likeness, and/or voice by Kantorei, its affiliates, and related lines of business, for any purpose whatsoever in connection with Kantorei or its events, including but not limited to advertising or promoting the event(s) you attended, similar Kantorei events in the future, or Kantorei’s general capabilities, in any and all media, including by way of example Kantorei’s website, apps, social platforms and print products, throughout the world in perpetuity.

By entering the event premises, you release Kantorei, its officers and employees, and each and all persons involved from any liability or obligations to you of any nature whatsoever arising out of or in connection with the taking, recording, publication, distribution or other use of such photographs, video and/or sound recordings, including but not limited to any liability for defamation, violations of rights of privacy or publicity, infringement of copyright, or any other right respecting the consent provided herein. You further waive all rights you may have to any claims for any royalty or other consideration in connection with any publication or use of these materials, and you waive any right you may have to inspect and/or approve any photo, video, or audio recording taken by Kantorei or the person or entity designated to do so by Kantorei.

You understand that all photography, filming, and/or recording will be done in reliance on this consent and release. If you do not agree to the foregoing, please do not enter the event premises

Anti-Harassment Policy

Kantorei (or the “ensemble”) is committed to providing employees, members of the ensemble, and the Board of Directors with an environment that is free of harassment and other abusive conduct.

This includes unlawful harassment of any kind (such as oral, written, visual, or electronic) for any reason, including sexual harassment and other unlawful harassment on the basis of race; color; religion or creed; sex or gender (including pregnancy, childbirth, breastfeeding or related medical conditions); age; physical or mental disability; medical condition; military or veteran status; national origin or ancestry; citizenship status; genetic information; marital and partnership status; sexual orientation; gender identity or expression; credit history; unemployment; status as a victim of domestic violence, stalking or sex offenses; height; weight; arrest or conviction record; affiliation with a spouse or domestic partner falling within the protected categories of this policy; or any other characteristic protected by applicable U.S. federal, state or local laws (collectively, “protected categories under this policy”). Without limitation, this policy governs conduct both in the workplace, and at rehearsals, performances, and at any other location at which a Kantorei employee, director, or member of the ensemble conducts Kantorei business or otherwise formally represents Kantorei.

Sexual or other unlawful harassment, or abusive conduct, whether committed by or against Kantorei personnel, members of the ensemble, members of the board of directors, volunteers, temporary employees, and/or independent contractors is strictly prohibited. Kantorei also will not tolerate sexual or other unlawful harassment, or abusive conduct committed by or against donors, audience members, subscribers, service providers, vendors, or suppliers. Sexual or other unlawful harassment, or abusive conduct is unacceptable in the workplace, at rehearsals or performances, and in any setting which is related to the activities of Kantorei, such as during business trips, meetings, and ensemble-related social events.

Definitions of Conduct Prohibited by This Policy

Sexual Harassment:  Sexual harassment means harassment based on someone’s sex or gender and is prohibited under this policy.  Unwelcome sexual advances, requests for sexual favors, and other verbal, physical, or visual conduct of a sexual nature may constitute sexual harassment when:

  • submission to or rejection of such advances, requests, or conduct is made either explicitly or implicitly a term or condition of the individual’s employment, membership, or other forms of participation in or with the ensemble;

  • submission to or rejection of such advances, requests, or conduct is used either explicitly or implicitly as a basis for employment, compensation, artistic, or other decisions affecting the individual with respect to the ensemble; or

  • such advances, requests, or conduct have the purpose or effect of unreasonably interfering with an individual’s work performance or participation in the ensemble by creating an intimidating, hostile, humiliating, or sexually offensive environment for work or other activities of the ensemble.

Although defining precisely the types of conduct that might constitute sexual harassment is difficult, examples of prohibited behavior include, without limitation, unwelcome sexual advances, requests for sexual favors, obscene gestures, displaying sexually graphic materials, sending sexually explicit email or voicemail, and other unwelcome verbal or physical conduct of a sexual nature, such as uninvited touching of a sexual nature or sexually related comments. Depending upon the circumstances, such conduct also can include sexual or offensive conversation or joking, commenting about an individual’s physical appearance, conversation about one’s own or someone else’s sex life, teasing, or other conduct directed toward a person because of that person’s gender which is sufficiently severe or pervasive to create a hostile environment for work or other activities of the ensemble. Sexual harassment includes harassment directed by a person of any gender toward another person.

Other Unlawful Harassment or Abusive Conduct:

Likewise, defining precisely conduct that constitutes “other unlawful harassment” or “abusive conduct” is difficult. However, conduct prohibited under this policy includes malicious conduct in the workplace or in the functions of the ensemble that a reasonable person would find hostile, offensive, and unrelated to Kantorei’s legitimate interests as an employer or as a membership based artistic ensemble. Such conduct may include repeated infliction of verbal abuse, such as the use of derogatory remarks, insults, epithets, unwelcome jokes, teasing, touching, or other verbal or physical conduct that a reasonable person would find threatening, intimidating, or humiliating, or the gratuitous sabotage or undermining of a person’s work or participation in the ensemble. When such conduct is based on protected categories under this policy, such conduct will generally be considered other unlawful harassment. When such conduct occurs but is not based on a protected category under this policy, such conduct is considered abusive conduct and is strictly prohibited regardless as to whether such conduct may be characterized as unlawful under applicable law.

A single act will generally not constitute conduct prohibited by this policy, unless especially severe and egregious.

Statement of Policy

Kantorei considers harassment and abusive conduct as completely unacceptable and will not tolerate it under any circumstances. The Managing Artistic Director is responsible to ensure that Kantorei employees and ensemble members do not engage in, and are not subjected to, harassment or abusive conduct. All complaints will be treated seriously and investigated promptly. During the investigation process, Kantorei will attempt to maintain confidentiality to the fullest extent possible.

Anti-Retaliation Policy

Kantorei (or the “ensemble”) aspires to uphold the highest levels of organizational ethics and personal integrity in all types of activities and interactions.

To further this commitment of Kantorei, and to ensure compliance with all applicable state and federal laws, Kantorei does not tolerate retaliatory behavior against any individual who raises a compliance concern.

Under this policy, retaliatory behavior is any behavior intended to intimidate, threaten, coerce, discriminate against, or take other retaliatory action, including without limitation, discharge, demotion, or suspension, against an individual who in good faith and in a reasonable manner exercises his or her right to report or otherwise disclose compliance concerns or other wrongdoing. For the purposes of this policy, an individual includes employees, management, directors, members of the ensemble, volunteers, vendors, contractors, trainees, interns, and other persons whose conduct is under the direct control of Kantorei, whether or not such persons are paid. However, an individual who knowingly makes a false allegation or provides false or misleading information during an investigation will be subject to disciplinary action, up to and including termination of employment, or membership in the ensemble, or other forms of affiliation with the ensemble, as applicable.

Kantorei takes seriously all reports or disclosures of compliance concerns. Kantorei will investigate compliance concerns promptly and will treat such reported concerns as confidential to the extent possible in applicable law. Kantorei will make every effort to protect the anonymity of any person who reports compliance concerns in good faith.

Non-Discrimination and Equal Employment Opportunity Policy

Kantorei (or the “ensemble”) is committed to the principle of equal employment opportunity for all employees of the ensemble and to providing employees with a work environment that is free of discrimination.

All aspects of the various activities of the ensemble including, without limitation, auditions, rehearsals, performances, determinations of artistic content, venue selection, artistic collaborations, grants and other fundraising activities, community engagement and all employment decisions, are based on needs of the organization, and where applicable, on individual qualifications and job requirements, in each case without regard to race, color, religion or belief, national, social or ethnic origin, sex (including pregnancy), age, physical, mental or sensory disability, HIV Status, sexual orientation, gender identity and/or expression, marital, civil union or domestic partnership status, past or present military service, family medical history or genetic information, family or parental status, or any other status protected by the laws or regulations in the locations that are applicable to the activities of the ensemble.
